PRIVACY POLICY

EU REGULATION 2016/679 OF THE EUROPEAN PARLIAMENT AND COUNCIL DATED 27 APRIL 2016

UNE S.r.l. provides this privacy policy in connection with the use of personal data, with respect both to the data you provided and those that UNE will learn in the performance of the contractual relationship with you.

1. Purposes of the personal data processing

Personal data will be processed for the following purposes:
a) pre-contractual: to respond requests for commercial information or offers submitted by the client and for any activity instrumental to the conclusion of supply or service agreements with UNE;
b) contractual: to supply and install our products and for any activity instrumental thereto, for the technical, administrative and accounting management of the relationship, for the provision of service notices;
c) to perform obligations set out under European or national laws, including orders by legitimate authorities (the purposes under letter a, b and c will be hereinafter referred to as “administrative purposes”);
d) with reference to the so called Zhero system, to monitor from remote the functioning of the product and, on specific request, to provide advice thereupon (“monitoring purposes”);
e) to deliver advertising or sale material or to perform market researches or commercial communications (“marketing purposes”), based on specific consent.

2. Modalities of personal data processing and storage period

The processing may also be performed by UNE or by third parties entrusted by UNE through electronic or automatic means, in order to memorize, manage or transmit personal data. The processing will be performed in such a way as to guarantee security and confidentiality.
Personal data will be stored for the time necessary to perform the purposes indicated in the foregoing and in particular for:
(i) no longer than 10 years from the end of the relationship as to administrative purposes;
(ii) no longer than 13 months for monitoring purposes;
(iii) no longer than 2 years for marketing purposes (if specifically consented)

3. Provision of personal data and consequences of the refusal to give consent

Provision of personal data is necessary to perform the activities referred to under paragraph 1 above. Refusal to provide personal data would prevent UNE from providing products and services.
With particular reference to the Zhero system and the functioning remote monitoring, without consent UNE would not be able to provide the product warranty.
Consent to personal data processing for marketing purposes is instead at all times discretional and revocable.

4. Transmission of personal data

Personal data may be transmitted, for the purposes referred to under paragraph 1 above, to third parties, in Italy or abroad, belonging to the following categories:Personal data may be transmitted, for the purposes referred to under paragraph 1 above, to third parties, in Italy or abroad, belonging to the following categories:
(a) parties providing services for the management of the products supplied by UNE;
(b) parties performing accounting, tax, employment and legal services in favor of UNE;
(c) parties performing control, audit and certification services in favor of UNE;
(d) financial entities, with respect to collection and payment transactions;
(e) other operators of the energy sector and of the energy dispatching services, for the management of the associated relationship;
(f) public entities, to the extent necessary to have access to public grants, contributions, subsides and similar, in relation to UNE business;
(g) companies controlling or controlled by UNE, for administrative, management and control purposes, and, if consented, marketing purposes;
(h) in general, all such public or private parties to which the personal data shall be transmitted for the due performance of the purposes indicated under paragraph 1 above.
All employees, consultants and collaborators, other than the parties indicated above, carrying out activity based on UNE’s instructions, are hereby appointed as people in charge for the processing. UNE gives them adequate instructions, with particular reference to the binding corporate rules aimed at guaranteeing confidentiality and security of personal data.

5. Dissemination of personal data

Personal data are not subject to dissemination.

6. Rights of the data subject

(i) the right to obtain confirmation as to whether or not personal data concerning him or her are being processed;
(ii) the right to be informed as to a) the source of personal data, b) the purposes and modalities of processing, c) the logic involved in the processing through electronic means, d) the details of the controller, e) the details of recipients to whom personal data may be disclosed;
(iii) the right to request update, rectification, integration or erasure of personal data, their anonymization, or the restriction or discontinuance of the processing in the case that the same is in breach of laws, as well as the right to obtain that third parties to whom personal data have been disclosed be informed as to the foregoing actions, save for the case in which this is impossible or involves disproportionate effort;
(iv) the right to receive the personal data concerning him or her, in a structured, commonly used and machine-readable format (so called “data portability”);
(v) the right to object to the personal data processing for legitimate reasons;
(vi) the right to object at any time and for any reasons to personal data processing for marketing purposes.
